Recent changes to the Federal Power Act as a result of Energy Policy Act of 2005 (EPAct ) will be summarized and discussed.  This course will review the Department of the Interior's role in Federal Energy Regulatory Commission (FERC) license proceedings and describe the new responsibilities the Service and other bureaus within the DOI have as a result of the EPAct.  The course will focus on changes to the FERC licensing process as a result of EPAct, including the Trial Type Hearing (TTH) and alternative analysis processes.  Specific topics will include: the process of developing conditions and prescriptions in expectation that they will be challenged in a trial-type hearing; the trial-type hearing process; the process of reviewing alternatives and deciding whether to modify preliminary conditions and prescriptions; and settlement in light of EPAct.  The discussions will also include: lessons learned from initial hearings, expert witness counseling, implementation guidance, the new Integrated Licensing Process; and appropriate negotiation skills.  Components of a hearing will be simulated to illustrate what to expect from the process.  

Who Should Attend:  This course is designed for natural resource agency personnel whose roles and responsibilities are related to hydropower project review and licensing by the FERC.

Length:  5 days/36 hours

Objectives: By the end of this session, the participant will be able to:

  • Summarize section 241 of the EPAct and the Interim Final Rules implementing the EPAct, including how the new trial-type hearing and alternative processes fit within FERC's license proceedings;
  • Develop an understanding of the roles of DOI staff in the FERC process, and enable effective communication among all involved parties;
  • Summarize the Integrated Licensing Process and discuss how that process differs from the Traditional and Alternative License proceedings;
  • Discuss how EP Act has changed Interior's role and responsibilities in FERC license proceedings.
